These Terms of Service govern access to and use of the Owyhee Strategic Solutions website, online store, content, products, training registrations, consulting services, and related services.
Throughout these Terms, “OSS,” “we,” “us,” and “our” refer to Owyhee Strategic Solutions. “You” and “your” refer to the person accessing the website, placing an order, registering for training, or using our services.
By accessing the website, placing an order, registering for a course, submitting information, or otherwise using our services, you agree to these Terms and to all policies referenced in them.
Do not use the website or purchase a product or service if you do not agree to these Terms.
1. Eligibility
You must be legally capable of entering into a binding contract in your jurisdiction.
A person under the age of legal majority may use the website or purchase an eligible product only with the involvement and permission of a parent or legal guardian.
Training programs may have separate minimum-age, identification, licensing, experience, equipment, physical ability, or legal eligibility requirements. Purchasing a registration does not waive those requirements.
2. Online Store and Website Use
You may use the website only for lawful personal or business purposes consistent with these Terms.
You may not:

Use the website or its content for an unlawful purpose

Violate applicable local, state, federal, national, or international law

Attempt to gain unauthorized access to the website, accounts, systems, or data

Introduce malware, destructive code, automated scraping tools, or other harmful technology

Interfere with website security, availability, or operation

Impersonate another person or submit false information

Use OSS content to mislead, defraud, threaten, harass, or harm another person

Copy, reproduce, distribute, resell, publish, or commercially exploit OSS materials without written permission

Use the website to facilitate the unlawful possession, transfer, transportation, or use of weapons, controlled items, or other regulated property
We may suspend or terminate access when we reasonably believe these Terms have been violated.
3. Products and Services
We make reasonable efforts to describe products and services accurately. Minor differences can occur in colors, sizing, materials, packaging, placement, production method, or screen display.
Product photographs are illustrative. A device display or photography conditions may affect how colors and details appear.
We may:

Restrict sales by person, location, jurisdiction, or market
These changes may be made without prior notice, but they will not alter a completed purchase in a manner prohibited by law.
4. Prices, Taxes, and Payment
Prices are stated in the currency displayed during checkout. Unless expressly stated otherwise, prices do not include shipping, customs duties, import charges, or taxes calculated during checkout or imposed after shipment.
You agree to provide current, complete, and accurate billing, payment, and contact information.
You represent that you are authorized to use the payment method submitted with the order.
Payment processing may be provided by Shopify or another third-party payment provider. OSS does not directly store complete payment-card information when it is handled by an authorized payment processor.
We may correct pricing or calculation errors before accepting an order. If an error affects an order already submitted, we may contact you for approval of the corrected amount or cancel and refund the affected order.
5. Orders and Acceptance
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that OSS has accepted the order.
We may reject, limit, verify, or cancel an order for reasons including:

Suspected fraud or unauthorized payment

Incorrect pricing or product information

Product unavailability

Shipping restrictions

Legal or regulatory concerns

Apparent resale or abusive ordering activity

Failure to meet a course or service eligibility requirement

A prior material violation of OSS policies
If we cancel an order after payment has been collected, we will issue the refund required by applicable law.
Ownership of physical merchandise transfers according to applicable law. Risk of loss transfers no earlier than permitted by applicable consumer law.
6. Shipping and Delivery
Physical merchandise is governed by the OSS Shipping Policy, which is incorporated into these Terms.
Some merchandise may be produced or shipped by third-party fulfillment partners. Products in one order may arrive from different locations or in separate packages.
Delivery dates are estimates unless expressly guaranteed in writing.
Customers are responsible for providing accurate delivery information and for paying customs charges, import duties, or other destination charges unless checkout states that those amounts are included.
7. Returns, Refunds, and Cancellations
Returns, refunds, exchanges, and merchandise cancellations are governed by the OSS Return and Refund Policy, which is incorporated into these Terms.
Product-specific, course-specific, proposal, invoice, or written service terms may establish additional requirements. Those specific terms control for the applicable purchase when they conflict with these general Terms.
Nothing in these Terms limits a mandatory consumer right that cannot legally be waived.
8. Training Programs
OSS provides educational and skills-based training that may include firearms, home defense, emergency planning, medical preparedness, rural skills, mounted skills, physical performance, leadership, team development, or related subjects.
Training may involve serious physical activity, equipment, animals, environmental exposure, weapons, vehicles, simulated emergencies, or other inherent risks.
Before participating, a student may be required to:

Complete an application or questionnaire

Verify identity, age, experience, or legal eligibility

Sign a separate participation agreement, release, assumption-of-risk form, medical disclosure, media release, or waiver

Follow an equipment and ammunition list

Attend a safety briefing

Demonstrate prerequisite skills

Follow instructor directions and facility rules
A separate signed training agreement or waiver is part of the participant’s contract with OSS. When a training-specific agreement directly conflicts with these website Terms, the training-specific agreement controls for that activity.
OSS may deny or end participation when reasonably necessary for safety, legal compliance, course integrity, or the protection of participants, instructors, property, animals, or the public.
Conduct that may result in removal includes:

Unsafe weapons handling

Reckless or threatening behavior

Intoxication or impairment
-
Harassment
-
Refusal to follow safety instructions

Materially false eligibility information

Possession of prohibited equipment or substances

Conduct that disrupts the course or creates an unreasonable risk
Removal for unsafe conduct or a material rule violation does not automatically entitle the participant to a refund.
9. Legal Responsibility of Training Participants
You are responsible for knowing and complying with laws governing any equipment, weapon, ammunition, vehicle, animal, communication system, medical item, or technique you possess or use.
Training does not authorize conduct that would otherwise be illegal.
OSS does not guarantee that completing a course will:

Satisfy a licensing or certification requirement

Qualify a participant for employment
-
Produce a particular level of performance
-
Meet another organization’s standards
-
Prevent injury, loss, criminal activity, or emergency events
-
Create authority to act as a law enforcement officer, medical professional, security professional, or government agent
Any certification or credential will be issued only when expressly described and when the student meets the applicable standard.
10. Educational Information and Professional Advice
Website content and general educational materials are provided for informational and training purposes.
They are not a substitute for individualized legal, medical, mental-health, financial, engineering, emergency, or other licensed professional advice.
Do not delay contacting emergency services, medical professionals, law enforcement, legal counsel, or another qualified professional because of information found on the website.
Recommendations must be evaluated against the user’s circumstances, abilities, local laws, environment, equipment, and professional obligations.
11. Digital Products and Course Materials
Digital products and course materials are licensed, not sold, for the purchaser’s personal or authorized internal use unless a written agreement states otherwise.
You may not, without written permission:

Reproduce or redistribute the materials

Share login or download access

Sell or sublicense the materials

Upload the materials to another website or platform

Record instruction when recording is prohibited

Use the materials to operate a competing course or commercial service

Remove copyright, trademark, attribution, or confidentiality notices
Access may be revoked for unauthorized copying, distribution, access sharing, or material misuse.
12. Intellectual Property
The website and its original content, including text, photographs, video, graphics, logos, designs, course structures, manuals, downloads, presentations, trademarks, trade dress, and other materials, are owned by or licensed to OSS and are protected by applicable intellectual-property law.
“Owyhee Strategic Solutions,” OSS marks, logos, names, designs, and slogans may not be used in a manner that suggests sponsorship, endorsement, affiliation, or authorization without written permission.
Limited personal access to the website does not transfer any ownership interest.
13. Reviews, Submissions, and Communications
When you voluntarily submit a review, photograph, testimonial, comment, suggestion, or other nonconfidential content, you represent that:

You own the content or have permission to submit it

The content is accurate to the best of your knowledge

The content does not violate another person’s rights

The content is not fraudulent, unlawful, defamatory, threatening, or malicious
You grant OSS a nonexclusive, worldwide, royalty-free license to use, reproduce, display, edit for length or formatting, and distribute the submitted content for legitimate business and promotional purposes, subject to applicable privacy law and any separate written agreement.
Do not send confidential, classified, export-controlled, privileged, protected health, law-enforcement-sensitive, or operationally sensitive information through ordinary website forms or email unless OSS has provided an approved method.
14. Third-Party Services and Links
The website may rely on or link to Shopify, payment processors, carriers, manufacturers, mapping tools, social platforms, scheduling tools, and other third-party services.
OSS does not control every third-party service and is not responsible for its independent content, availability, security, privacy practices, or terms.
Your use of a third-party service may be governed by that provider’s own terms and policies.
A link does not necessarily constitute an endorsement.
15. Privacy
Personal information is handled according to the OSS Privacy Policy and applicable law.
By submitting an order, registration, inquiry, or account request, you authorize OSS and its service providers to use the information reasonably necessary to process the transaction, communicate with you, prevent fraud, provide the requested service, and meet legal obligations.
16. Errors and Availability
The website may occasionally contain typographical errors, inaccurate descriptions, incomplete information, outdated availability, or technical problems.
We may correct errors and update information at any time. When a correction materially affects an order, we will provide the notice, cancellation option, or refund required by law.
We do not guarantee that the website will always be uninterrupted, secure, error-free, or compatible with every device.
17. Disclaimer of Warranties
To the fullest extent permitted by law, the website and general online content are provided on an “as available” basis.
OSS disclaims implied warranties to the extent they may legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
This disclaimer does not eliminate:

Liability that cannot legally be excluded

18. Limitation of Liability
To the fullest extent permitted by law, OSS will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or an online purchase, including lost profits, lost data, business interruption, or loss of opportunity.
For claims arising from an online product or service purchase, OSS’s aggregate liability will not exceed the amount paid to OSS for the product or service giving rise to the claim, except where a greater remedy is required by law.
Nothing in these Terms excludes or limits liability for intentional misconduct, fraud, gross negligence, personal injury, death, or another matter to the extent applicable law prohibits that exclusion or limitation.
Training-related risks, releases, and liability terms may also be addressed in a separate signed participation agreement.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold OSS and its owners, personnel, contractors, and service providers harmless from third-party claims, losses, liabilities, and reasonable costs arising from:

Your unlawful use of the website or services

Your material violation of these Terms

Your infringement of another person’s rights

Content you submit

Your intentional or reckless misconduct
This section does not require a consumer to indemnify OSS for OSS’s own unlawful conduct or for liability that cannot legally be shifted.
20. Termination
We may restrict or terminate website access for a material violation of these Terms, unlawful conduct, fraud, security threats, harassment, abuse, or activity that creates a risk to OSS or others.
Obligations that logically continue after termination remain in effect, including payment, intellectual-property, confidentiality, disclaimer, limitation-of-liability, and dispute provisions.
21. Governing Law and Disputes
These Terms are governed by the laws of the State of Idaho and applicable United States federal law, without regard to conflict-of-law principles.
Subject to any mandatory consumer rights, claims that cannot be resolved informally will be brought in a court with lawful jurisdiction in Idaho.
Before filing a claim, the parties should make a reasonable good-faith effort to resolve the matter by written communication.
Consumers may retain the right to bring a claim in another jurisdiction when that right cannot legally be waived.
22. Severability and Waiver
If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.
A failure by OSS to enforce a provision on one occasion is not a waiver of the right to enforce it later.
23. Entire Agreement
These Terms, the Privacy Policy, Return and Refund Policy, Shipping Policy, product descriptions, and any applicable written registration or service agreement form the agreement between you and OSS concerning the relevant use or purchase.
A course agreement, proposal, invoice, statement of work, or other signed writing may add to or modify these Terms for a particular transaction.
24. Changes to These Terms
We may update these Terms to reflect changes in the website, products, services, business practices, or legal requirements.
The revised Terms will be posted with a new “Last updated” date. Changes apply prospectively unless applicable law permits or requires otherwise.
Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.
